Everything Canadian Drone Pilots Need to Know in 2026

Flying a drone in Canada involves more than staying below 400 feet and keeping the aircraft within sight. The rules that apply to a flight depend on the aircraft’s operating weight, its safety features, the airspace, proximity to people and aerodromes, and whether the operation is Basic, Advanced, Level 1 Complex or Special.

Transport Canada regulates drones as aircraft under the Aeronautics Act and the Canadian Aviation Regulations. Pilots are responsible for identifying the correct operating category before every flight.

This guide provides an overview of the current Canadian RPAS framework. It is intended as general educational information and should be used alongside the Canadian Aviation Regulations, Transport Canada guidance, NOTAMs, airspace information and any operation-specific authorization.


What Is an RPAS?

Transport Canada commonly uses the term Remotely Piloted Aircraft System, or RPAS.

An RPAS includes the remotely piloted aircraft and the associated components required for its safe operation, which may include:

  • the remote-control station;

  • command-and-control links;

  • navigation and positioning systems;

  • software and firmware;

  • payloads;

  • antennas; and

  • supporting equipment.

The applicable rules depend primarily on the aircraft’s operating weight and the way the system will be used.


Canadian Drone Weight Categories

Transport Canada divides remotely piloted aircraft into four primary weight categories.


Microdrones: Under 250 Grams

A microdrone has an operating weight of less than 250 g.

Microdrone pilots generally do not need to:

  • register the aircraft; or

  • hold a Transport Canada drone pilot certificate.

However, microdrones are still aircraft. They must not be operated recklessly or negligently, and pilots must avoid creating a risk to aviation safety or people on the ground.

Microdrone pilots should:

  • remain well clear of crewed aircraft;

  • avoid restricted airspace unless permission has been obtained;

  • remain away from emergency operations;

  • respect privacy;

  • avoid flying where the pilot cannot safely control the aircraft; and

  • check for local, provincial and federal restrictions.

An SFOC-RPAS is required to operate a microdrone at an advertised event.

The aircraft’s category is determined by its operating weight. If an accessory, larger battery, propeller guard or payload increases the weight to 250 g or more, the aircraft must be operated under the rules applicable to a small RPAS.


Small RPAS: 250 Grams to 25 Kilograms

A small RPAS has an operating weight of at least 250 g but not more than 25 kg.

This category includes most consumer, enterprise, public-safety and professional mapping drones.

Small RPAS generally must be:

  • registered with Transport Canada;

  • marked with the registration number; and

  • operated by a pilot holding the certificate required for the intended operation.

A small RPAS may be operated under the Basic, Advanced, Level 1 Complex or Special Operations framework, depending on the mission.


Medium RPAS: More Than 25 Kilograms to 150 Kilograms

A medium RPAS weighs more than 25 kg but not more than 150 kg.

Medium RPAS can be operated under certain Advanced, Level 1 Complex or Special Operations provisions.

For example, a qualified Advanced pilot may conduct eligible VLOS operations with a medium RPAS when:

  • the aircraft has the required safety declaration;

  • the operation remains within the privileges of the Advanced category;

  • applicable airspace permission is obtained; and

  • all aircraft and operational requirements are satisfied.

Medium RPAS operations are not automatically classified as Level 1 Complex, although many missions involving these aircraft require more extensive planning and aircraft assurance.


Large RPAS: More Than 150 Kilograms

Aircraft weighing more than 150 kg generally fall within the Special Operations framework and require specific Transport Canada authorization.


Drone Registration

All drones weighing at least 250 g must generally be registered with Transport Canada before being operated.

The registration number must be clearly marked on the aircraft, and the pilot must carry proof of registration when required.

Registration belongs to the aircraft. It does not establish that the pilot is qualified to conduct the flight.

Pilots should update the registration information when ownership or aircraft information changes and should cancel registrations for aircraft that are permanently withdrawn or transferred where required.


Canadian Drone Pilot Certificates

Canada has three principal RPAS pilot-certificate levels:

  1. Basic Operations;

  2. Advanced Operations; and

  3. Level 1 Complex Operations.

The required certificate is based on the intended operation—not whether the flight is recreational or commercial.

A person may conduct paid work under Basic Operations when every Basic condition is met. Conversely, a recreational flight may require an Advanced Certificate if it takes place in controlled airspace or close to people.


Basic Operations

The Basic Certificate is intended for lower-risk VLOS operations with small RPAS.

Basic Operations generally require the pilot to:

  • operate a small RPAS;

  • remain in uncontrolled airspace;

  • remain within visual line of sight;

  • maintain the required distance from bystanders;

  • remain outside the prescribed distances from certified airports and heliports unless another authorization applies; and

  • comply with all general operating rules.

To obtain a Basic Certificate, a person must meet the minimum age requirement and pass Transport Canada’s Small Basic Exam.

A Basic Certificate does not authorize flight in controlled airspace or closer to people than the Basic rules permit.


Advanced Operations

An Advanced Certificate provides additional privileges, but the certificate alone does not authorize every Advanced flight.

Depending on the operation, the pilot must also have:

  • an aircraft that meets the applicable RPAS Safety Assurance requirements;

  • the appropriate manufacturer or operator declaration;

  • air traffic control permission;

  • a completed site survey;

  • required records and documentation; and

  • compliance with the aircraft’s operating limitations.

Eligible Advanced Operations can include:

  • flight in controlled airspace with permission;

  • flight closer to bystanders;

  • flight near or over people when the applicable safety-assurance requirements are met;

  • VLOS operations with eligible medium RPAS;

  • sheltered operations; and

  • Extended Visual Line-of-Sight operations in uncontrolled airspace.

To obtain an Advanced Certificate, the applicant must pass the Advanced Exam and successfully complete an Advanced Flight Review.


Level 1 Complex Operations

Level 1 Complex Operations support specified lower-risk BVLOS operations under a standardized regulatory framework.

A Level 1 Complex pilot may also conduct Basic and Advanced Operations, provided all requirements for those operations are met.

To obtain a Level 1 Complex Certificate, the applicant must meet Transport Canada’s eligibility requirements, which include:

  • completing the required ground-school training;

  • passing the Advanced Exam;

  • passing the Level 1 Complex Exam;

  • successfully completing a Level 1 Complex Flight Review; and

  • applying for the certificate through the Drone Management Portal.

When conducting a complex operation, the pilot must operate under an RPAS Operator Certificate, commonly called an RPOC.

A Level 1 Complex Certificate does not provide unrestricted authority to conduct any BVLOS flight. The operation must fit within the defined Level 1 Complex framework. BVLOS operations outside that framework require an SFOC-RPAS.


The RPAS Operator Certificate

An RPOC is issued to the organization responsible for conducting complex RPAS operations.

The pilot certificate qualifies the individual pilot. The RPOC establishes that the organization has suitable systems for:

  • operational control;

  • training and competency;

  • aircraft maintenance;

  • personnel responsibilities;

  • manuals and procedures;

  • record keeping;

  • incident management; and

  • regulatory oversight.

A qualified Level 1 Complex pilot cannot independently exercise complex-operation privileges unless the flight is conducted under an eligible RPOC.


Visual Line of Sight and BVLOS

For most Basic and Advanced flights, the pilot or visual observer must maintain unaided visual contact with the aircraft.

Visual contact must be sufficient to:

  • know the aircraft’s location;

  • determine its attitude, altitude and direction;

  • observe the surrounding airspace;

  • detect hazards; and

  • take timely action to avoid conflicts.

Certain Extended Visual Line-of-Sight, sheltered and BVLOS operations are permitted under specified Advanced or Level 1 Complex provisions.

All other BVLOS operations require an SFOC-RPAS.


Controlled Airspace

Controlled airspace exists around many airports and within other designated areas.

Eligible drone pilots may operate in controlled airspace when:

  • they hold the appropriate pilot certificate;

  • the RPAS satisfies the safety requirements for the operation;

  • permission is obtained from the responsible air traffic control authority; and

  • all authorization conditions are followed.

Advanced pilots can normally request permission for NAV CANADA-controlled airspace through NAV Drone.

Airspace controlled by the Department of National Defence requires the applicable DND permission process.

A pilot should never assume that an app approval is the only authorization required. The pilot must also verify NOTAMs, restricted airspace, local limitations and operation-specific requirements.


Airports, Aerodromes and Heliports

Drone pilots must avoid interfering with established aircraft traffic patterns.

Basic pilots are subject to prescribed distances from certified airports and heliports. Advanced pilots may be permitted to operate closer when the applicable regulatory, aircraft and authorization requirements are met.

An aerodrome may exist even when controlled airspace is not present. Pilots must identify nearby airports, heliports, water aerodromes, private strips and other aviation activity during the site survey.


Advertised Events

An advertised event can include a concert, festival, sporting event, public gathering, airshow or similar event that has been publicly promoted.

An SFOC-RPAS is required to operate any drone at an advertised event, including a microdrone weighing less than 250 g.

For aircraft weighing 250 g or more, Transport Canada may also require:

  • the appropriate pilot certification;

  • aircraft registration;

  • suitable safety-assurance declarations;

  • procedures for operating near or over people; and

  • compliance with the conditions listed in the SFOC.

Holding an Advanced or Level 1 Complex Certificate does not, by itself, authorize flight at an advertised event.


Emergency Sites and Security Perimeters

Drone pilots must stay away from emergency operations unless they are specifically authorized and coordinated with the responsible authority.

The Canadian Aviation Regulations prohibit operating an RPAS over or within an emergency security perimeter established by a public authority.

Emergency scenes may include:

  • wildfires;

  • police incidents;

  • traffic collisions;

  • disaster areas;

  • search-and-rescue operations;

  • medical emergencies; and

  • firefighting scenes.

Unauthorized drones can force emergency aircraft to stop operating and may place responders and members of the public at risk.

Exceptions exist for authorized operations conducted to save human life, support police or firefighting activities, or otherwise serve a public authority.


Special Flight Operations Certificates

An SFOC-RPAS provides authorization for an operation that falls outside the Basic, Advanced or Level 1 Complex rules.

An SFOC may be required for:

  • operation at an advertised event;

  • BVLOS operations outside the Level 1 Complex framework;

  • operation of a large RPAS;

  • certain foreign-pilot or foreign-owned aircraft operations;

  • unusual or higher-risk missions;

  • research, testing or novel technology;

  • operations outside Canadian domestic airspace; or

  • any operation specifically identified by the regulations as requiring special permission.

An SFOC is not a general drone licence. It authorizes a specified operation subject to stated conditions.


RPAS Safety Assurance

For many Advanced and Complex Operations, the aircraft must meet the applicable RPAS Safety Assurance requirements.

Different declarations apply to different activities, including:

  • controlled-airspace operations;

  • operations near people;

  • operations over people;

  • medium-RPAS operations;

  • certain BVLOS operations; and

  • technical systems supporting detect-and-avoid or command-and-control functions.

An aircraft declared suitable for one type of operation is not automatically suitable for every other operation.

Pilots should confirm the aircraft’s declaration status in Transport Canada’s system before planning the mission.


Site Surveys and Flight Planning

Before conducting an operation, pilots should survey the proposed area and identify factors that may affect safety.

A site survey may include:

  • airspace classification;

  • nearby aerodromes and heliports;

  • NOTAMs;

  • obstacles;

  • bystanders;

  • buildings and roads;

  • weather;

  • emergency landing areas;

  • communications;

  • crew positions;

  • takeoff and landing areas;

  • wildlife;

  • radio-frequency interference;

  • emergency procedures; and

  • local restrictions.

Complex operations require more formal risk-management and operational-planning systems.


Record Keeping

The records required depend on the aircraft, operational category and organization.

Relevant records may include:

  • aircraft registration;

  • maintenance actions;

  • modifications;

  • pilot certificates;

  • proof of recency;

  • training and competency records;

  • flight records;

  • site surveys;

  • airspace authorizations;

  • operational risk assessments;

  • incident reports;

  • battery or component records; and

  • organizational manuals.

Not every suggested record is legally required for every Basic flight. However, maintaining clear records is an important professional practice and may be required under Advanced, Complex, RPOC or SFOC provisions.


Incidents and Accidents

Certain occurrences require the pilot to immediately stop operating until the cause has been analyzed and corrective action has been taken.

Examples include:

  • an injury requiring medical attention;

  • unintended contact between the aircraft and a person;

  • an unplanned collision;

  • a loss of control;

  • an airspace violation;

  • a flyaway; or

  • another occurrence indicating that the operation may no longer be safe.

Additional reporting obligations may apply under the Transportation Safety Board Regulations or the conditions of an RPOC or SFOC.


Pilot Recency

Transport Canada drone pilot certificates do not normally expire, but pilots must maintain recency.

A pilot must have completed an accepted recency activity within the preceding 24 months and must carry proof while operating.

Accepted activities may include:

  • passing an applicable Transport Canada examination;

  • completing a flight review;

  • completing an approved recurrent-training activity; or

  • completing Transport Canada’s current self-paced RPAS study program.

The completed proof of recency should be retained and made available when requested.

Level 1 Complex pilots must ensure that their recurrent training satisfies the requirements applicable to that certificate.


General Rules Applying to Drone Pilots

Regardless of aircraft weight or certificate level, pilots should:

  • give way to crewed aircraft;

  • never operate recklessly or negligently;

  • follow airspace restrictions;

  • avoid emergency operations;

  • comply with NOTAMs;

  • stay within the aircraft’s operating limitations;

  • confirm weather conditions;

  • inspect the aircraft before flight;

  • prevent unsafe fatigue, impairment or distraction;

  • respect privacy and local restrictions; and

  • discontinue a flight when it cannot be continued safely.


Which Certificate Do You Need?

The correct certificate depends on the operation.

A Basic Certificate may be sufficient when operating a small RPAS in uncontrolled airspace, within VLOS, away from bystanders and outside the applicable aerodrome limitations.

An Advanced Certificate is generally needed for eligible flights in controlled airspace, near people, near aerodromes, with medium RPAS, or during approved EVLOS or sheltered operations.

A Level 1 Complex Certificate is required for pilots conducting eligible complex operations, including specified lower-risk BVLOS missions. Complex flights must also be conducted under an RPOC.

An SFOC-RPAS is required when the proposed operation falls outside the Basic, Advanced or Level 1 Complex frameworks.

Canada’s RPAS rules are built around the interaction between the aircraft, pilot, operator, airspace and proposed mission.

Registration alone does not authorize a flight. A pilot certificate alone does not guarantee that a specific aircraft or mission is eligible. For Advanced and Complex Operations, pilots must also consider aircraft declarations, airspace authorization, organizational certification and operation-specific limitations.

Before every flight, identify:

  1. the aircraft’s operating weight;

  2. the applicable operating category;

  3. the required pilot certificate;

  4. the aircraft’s safety-assurance eligibility;

  5. the airspace and aerodrome requirements;

  6. whether an RPOC or SFOC is required; and

  7. the records and authorizations that must be carried.
